			<content:encoded><![CDATA[<p>In 5th May, I had the chance to testify for Public hearing at EU Parliament (via remote participation) for Greens/EPA MEPs, to present about Tunisian case during the revolution. I tried to link that to Internet Policy (I think there were enough panels about &#8220;social media and Arab spring&#8221;) which affect more users but it is hard to engage activists about it (talking about net policy in general and not trendy topic like internet filter as well as privacy) .</p>

			<content:encoded><![CDATA[<p>Since the Tunisian revolution, I saw some people calling for amending the right for Internet access in the Tunisian constitution. I am not sure how we can define such right that but it let me to remember the several attempts (yep it is not something new) for defining a charter for user rights or Internet bill of rights or to some extent the core principles for Internet, it depends to the perspective of the promoters and those charters can overlap and be complementary. I tried to collect some links :</p>
<ul>
<li><a href="http://internetrightsandprinciples.org/node/367">Charter of Human Rights and Principles for the Internet</a> : still in beta version, detailed charter drafted by the Dynamic Coalition for Internet Rights and Principles from people involved on Internet Governance working to let it compliant to international treaties and,taking different perspective and to be exhaustive.  (Disclosure: I am member of the steering committee of the DC but not involved in the charter drafting)</li>
<li><a href="http://www.cgi.br/english/regulations/resolution2009-003.htm">Principles for the governance and use of the Internet</a> : 10 principles stated by the Brazilian Internet Steering committee (a multistakeholder body)  not focused in the user rights but more in the core principles for free and open Internet</li>
<li><a href="http://christianengstrom.wordpress.com/2009/11/28/lets-write-an-internet-bill-of-rights/">Internet Bill of Rights </a> : another attempt to draft Internet Bill of Rights which is led by Swedish pirate party MEP Engstrom, I am not sure about the status of this project (the previous IBR projects : <a href="http://internetrightsandprinciples.org/node/14">1</a> and <a href="http://arstechnica.com/tech-policy/news/2009/11/god-did-it-why-cant-we-un-ponders-net-10-commandments.ars">2</a> ).</li>
<li><a href="http://homes.eff.org/~barlow/Declaration-Final.html">The Declaration of The Independence of the Cyberspace</a> : I guess the first &#8220;proto-charter&#8221; led by John Perry Barlow clearly asking states to not intervene on Internet and de facto protecting user rights there.</li>
<li><a href="http://www.ourdeclaration.net/en">Declaration of Digital Rights</a> : project lead by some (or all?) Pirate Parties, translated in different languages and containing set of principles. not sure if it is the same project led by Engstrom</li>
<li><a href="http://fcforum.net/charter">Charter for Innovation, Creativity and Access to Knowledge</a>: project from Free Culture Forum , it is not a charter about Internet rights per se but it focuses on the A2K aspect becoming critical with Internet (or amplified by Internet)</li>
<li><a href="http://www.buzzmachine.com/2010/12/10/bill-of-rights-in-cyberspace-amended-2/">Bill of Rights in Cyberspace</a>: a yet another  Internet bill of rights, this time suggested by Jeff <del>Jeffries </del> Jarvis, someone forgot to google before starting his project <img src='http://s0.wp.com/wp-includes/images/smilies/icon_smile.gif' alt=':)' class='wp-smiley' /> ? seriously, I think that the promoter wanted more simple charter and the context was related to wikileaks.</li>

<p>[UPDATE] : Thanks to suggestion and correction from <a href="http://twitter.com/#!/meryemmarzouki">Mrs Meryem Marzouki</a> an experienced Human Rights and Internet activist, we can list two other initiatives, but I could find a link only to one charter:</p>

<li><a href="http://www.apc.org/en/pubs/about-apc/apc-internet-rights-charter">APC Internet Rights charter</a> : one of most exhaustive charter which is used as source for Internet Rights and Principles charter, and also more &#8220;operational&#8221;, promoted by Association for Progressive Communication an old organization operating in many developing countries and active to represent civil society in Internet field.</li>
</ul>

			<content:encoded><![CDATA[<h3 style="text-align:justify;">Le hasard fait bien les choses, l’idée de blogger à propos de internet policy était présente depuis l’année dernière mais c&#8217;est enfin aujourd&#8217;hui que je vais commencer a poster et quoi de mieux que de parler du cas de la Tunisie.  Je vais essayer ici d’énumérer quelques idées (pas tres révolutionnaires) mais qui sont déjà appliqués ou en cours d&#8217;applications dans certains pays. De plus,  je en parlerai a partir de mon expérience comme participant a l&#8217;IGF (<a title="Internet Governance Forum" href="www.intgovforum.org">Internet Governance Forum</a> ) et  a l&#8217;<a title="ICANN" href="http://www.icann.org">ICANN</a> et j’espère continuer dans un prochain post et les développer en détails:</h3>
<ol style="text-align:justify;">
<li>
<h3>Repenser      le réseau Internet Tunisien: l’infrastructure et      le réseau Tunisien a été conçu dans une logique      de contrôle et de centralisation en empêchant les FAI      d&#8217;avoir leur points de connexion internationaux et de      passer nécessairement a travers l&#8217;ATI (hormis les autres      fournisseurs d’accès publiques). C&#8217;est a contraire du bon sens      et les &#8220;raisons&#8221; qui      ont été derrière ça n&#8217;existent plus      ou plutôt sont en train de devenir caduque. Il      faut nécessairement décentraliser et ne pas avoir ce <a title="single point of failure" href="http://en.wikipedia.org/wiki/Single_point_of_failure">single point of      failure</a> très dangereux pour      la sécurité et la stabilité de tout le réseau. de      plus il faut encourager le maximum de peering. En un mot, il faut revoir      le rôle de l&#8217;ATI  et arrêter de la diaboliser.</h3>

<h3>Le <a href="http://www.uta.fi/laitokset/tiedotus/opiskelu/kurssimateriaalit/mejos7_klk10/1011688227.pdf">Multistakeholder      model</a> ou <a href="http://press.terminus.net.au/igfbook/download.html">modèle participatif</a>:      l&#8217;ironie est que ce modele a connu son vraie essor des le SMSI organisé      en Tunisie en 2005 pour une gouvernance d&#8217;internet impliquant      toutes les parties prenantes comme les gouvernements (et      organisations intergouvernementales) , secteur privée,       société civile, communauté technique d&#8217;internet      (opérateurs, IXP, registries etc). Ce modèle permettant une      vraie consultation de tous les acteurs et evitant      la prédominance d&#8217;un groupe dans la prise de décision. C&#8217;est un modèle qui devrait être appliquée en Tunisie (la Tunisie a      accepté <a href="http://www.itu.int/wsis/docs2/tunis/off/6rev1.html">l&#8217;agenda de      Tunis</a> du SMSI ) a      travers des consultations régulières incluant tous les acteurs      et spécialement la société civile, créer des      conseil d&#8217;administrations avec des représentants de ces acteurs      ou encore mieux créer une <a href="http://www.cgi.br/english/about/definition.htm">internet      steering committe</a>e selon      le modèle brésilien en l’améliorant avec      une représentation équilibré de tous les acteurs du net et      une vraie approche bottom-up dans le prise de décision.</h3>
</li>
<li>
<h3>Représentation internationale      de la Tunisie:  Pour la gouvernance d&#8217;Internet  l&#8217;IGF reste le      forum adéquat pour les discussion sur le présent et le      futur d&#8217;internet, la participation Tunisienne n&#8217;est      pas vraiment visible et je conseillerai le secrétaire d’état au      TIC de participer a la prochaine édition a Nairobi. De plus,      la Tunisie traine une certaine mauvaise      image spécialement dans les participants de beaucoup      de pays de la société civile vu les incidents      des réunions prepcoms (avant le SMSI) et durant le SMSI. La      Tunisie peut y remédier en participant activement au groupe de      travail <a href="http://www.unctad.info/upload/CSTD-IGF/IGFsummary.pdf">CSTD</a> destiné      a travailler sur l&#8217;avenir de l&#8217;IGF et d&#8217;eviter de s&#8217;aligner sur les      positions de pays comme l&#8217;inde ou la chine qui pousse a un contrôle gouvernementale      sur Internet au lieu d&#8217;un vraie modèle participatif. L&#8217;exemple      Tunisien de contrôle d&#8217;Internet  sous l&#8217;ancien regime a      montre le défaillance de ce modèle. Je conseillerai aussi      une présence Tunisienne plus importante  a  l&#8217;ICANN et      specialement avoir un represantant gouvernemental au GAC, la <a href="http://svsf40.icann.org/">prochaine </a><span style="text-decoration:underline;">réunion </span>aura lieu mars prochain et      je conseillerai vivement      au secrétaire d’état d&#8217;y être.</h3>

<h3>Censure doit      etre levée: oui la censure a ete levée mais pas en ca      totalite. La discussion portant sur le contenu pornographie est un vrai      faux débat. En effet, ça permet le maintien d&#8217;une      infrastructure de filtrage Internet tant décrié pendant      des années, et le fait que ca soit encore fait par      une autorité administrative est erronée. Seule la justice      peut décider de bloquer un site ou pas et      faudra déjà définir les criteres qui      sont très vagues et permettent beaucoup d’interprétations.      ce qui me choque le plus, c&#8217;est l&#8217;explication du monsieur      le secrétaire d’état qui mentionne comme exemple les      pays développés car ca releve d&#8217;une      certaine méconnaissance de la vraie situation dans ces pays. Oui      un pays comme l&#8217;Australie a décidé de l&#8217;appliquer contre      la pédopornographie en créant une liste      non contrôlé et secrète mais les abus sont vites      arrives. certains pays comme l&#8217;Italie applique ca en envoyant une liste      aux FAIs pour faire du DNS-poisoning et le Japon laisse les FAIs appliquent      ca sur la base de la volontariat. Mais tout ca releve du      cas spécifique de la pédopornographie et certains      associations de protection d&#8217;enfance pensent que c&#8217;est une fausse      bonne idée et rien ne démontre leur efficacité.      Si on veut proteger nos enfants du contenu &#8220;non désirable&#8221;,       il faut plutôt encourager les parents a jouer      leur rôle de supervision au lieu de déléguer ca,      travaillons sur l’éducation plutot que sur la repression. Il      faut plutôt responsabiliser les utilisateurs et les laisser      decider avec leur libre arbitre que de les traiter comme des mineurs.</h3>

<li>
<h3>Libéraliser le      domaine .tn et .تونس : il faut se rendre a l’évidence que le .tn      n&#8217;a jamais réussi décoller en Tunisie (moins de 10000 nom de      domaines) alors que la demande y est certainement. Ceci est du aux      protections très strictes pour les trademark  et      la réglementation pour l&#8217;acquisition de noms de domaines (c&#8217;est      en cours de changement), il faut libéraliser et ne plus      restreindre l’accès aux nom de domaines pour les tunisiens spécialement les      personnes physiques. En plus, il faudra lever  les contraintes comme      le nécessité d’héberger en Tunisie pour pouvoir      demander un domaine sous .tn. Ca créera une      vraie activité de registrar pour nos FAIs mais aussi pour      d&#8217;autres entreprises tunisiennes qui pourront aussi chercher a être des <a href="http://icann.org/en/registrars/">registrars accrédites ICANN</a>.      De plus, le lancement du <a href="http://icann.org/en/topics/idn/">IDN</a> .تونس  est      une opportunité non négligeable pour relancer le      secteur et encourager le contenu en langue arabe.</h3>
</li>
<li>
<h3>Déploiement du      IPv6: il faut accélérer le processus de déploiement du      IPv6 et surtout encourager les FAI de l&#8217;adopter mais aussi aider      les entreprises dans leurs transitions.</h3>
</li>
<li>
<h3>Accès au      haut débit:  faut augmenter le taux de pénétration au      haut débit dans les régions tunisiennes en abaissant      les prix mais aussi a créer plus      de compétitions et libéraliser le marche. Faut aussi      revoir le modèle économique des publinets.</h3>
</li>
<li>
<h3><a href="http://en.wikipedia.org/wiki/Net_neutrality">Neutralité du      Net</a>: la discussion a déjà commencé sous l&#8217;égide de<span style="text-decoration:underline;">l’autorité</span><a href="http://www.intt.tn/site/fr/article.php?id_article=118"> de </a><span style="text-decoration:underline;">régulation</span> avec les opérateurs télécoms      mobiles qui vu leur positions dominantes et l&#8217;absence de consultation      publique peuvent être a l&#8217;encontre des intérêts des      utilisateurs d&#8217;internet.</h3>
</li>
<li>
<h3>Protection des données privées: malgré la présence de loi pour la protection des données personnelles, elle est peu appliquée et la protection de la vie privée reste au deçà des standards internationaux, La Tunisie pourrait s&#8217;inspirer le modèle de l&#8217;UE pour la protection de la vie privée</h3>
</li>
</ol>
<h3 style="text-align:justify;">Ce sont juste quelques idées a développer et a discuter, la réforme de l&#8217;internet policy en Tunisie n&#8217;est qu&#8217;un des chantier a entreprendre et permettra enfin aux tunisiens de jouir de pleins potentielles d&#8217;internet sur toues les aspects: social, économique etc.  Quelques livres conseillés:  Ce sont quelques livres qui donnent une vision globale sur la gouvernance d&#8217;internet et ses enjeux.</h3>

		<title>Why this blog? no it is not too late</title>

			<content:encoded><![CDATA[<p>First, I have blogged before  for a while in anonymous way and was member of Tunisian blogger community. I just stopped blogging regularly since more than one year and I think because I liked the interaction through channels like twitter and facebook.</p>
<p>The obvious question: why blogging now? It is easy and hard to explain. In fact, even if I stopped blogging, I was in contact with bloggers community somehow like making few translations with <a href="http://fr.globalvoicesonline.org/">GV-Lingua</a> from English to French or amazingly through twitter (people discover more new blogs with twitter).  Moreover,  I am still interested by issues related to Internet governance or more specifically to domain names and sometimes 140 characters aren&#8217;t really enough to express structured opinion. I saw many people   using blogs as way to develop their ideas about those topics and sharing the link in addition to discuss in classic channels like mailing lists and so on.  I thought that will be interesting to write posts to voice my own ideas and not just in mail exchange which is not really aimed to be easily available.</p>
<p>I am going to restrict my posts to to only topics related to Internet policy but I also want to talk about my experience in Japan (it won&#8217;t be really personal). In addition to that, I don&#8217;t want to write only in one language but having a multilingual blog (long life to Multilinguism!) .</p>
<p>It is enough for today and I hope that I am not going to stop early the experience.</p>
